ASSUMPTION OF RISK AND LIABILITY WAIVER

PLEASE READ THIS DOCUMENT CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. BY COMPLETING A BOOKING ON THE PLATFORM AND CHECKING THE REQUIRED CONSENT CHECKBOX, YOU VOLUNTARILY AGREE TO THE TERMS BELOW, INCLUDING A RELEASE AND WAIVER OF CERTAIN LEGAL RIGHTS.

1. APPLICABILITY

This Assumption of Risk and Liability Waiver ("Waiver") applies to all Activity bookings made through the KidzMaps platform at www.kidzmaps.com. By completing a booking and checking the required consent checkbox during checkout, you ("Parent/Guardian") agree to this Waiver on behalf of yourself and the participating child or children ("Participant(s)").

"Activity Provider" refers to the provider of the Activity as identified in your booking confirmation.

"KidzMaps" refers to KidzMaps, LLC, operator of the marketplace platform.

2. ACKNOWLEDGMENT OF RISKS

By completing a booking, you acknowledge and understand that:

• Participation in children's activities, camps, classes, sports, and recreational programs involves inherent risks, including but not limited to physical injury, emotional distress, illness, disability, and in rare cases, death;
• These risks may arise from the Participant's own actions, the actions of others, the condition of facilities or equipment, weather conditions, or other foreseeable and unforeseeable circumstances;
• Specific risks may include: falls, collisions, sprains, fractures, cuts, bruises, concussions, heat-related illness, allergic reactions, communicable diseases, drowning, insect bites/stings, sunburn, and transportation-related incidents;
• KidzMaps is a marketplace platform that facilitates connections between Parents and Activity Providers. KidzMaps does not operate, supervise, or control any Activities;
• The Activity Provider is solely responsible for the conduct, safety, and supervision of the Activity; and
• You have had the opportunity to review the Activity listing and ask questions about the Activity and its risks before booking.

3. VOLUNTARY ASSUMPTION OF RISK

BY COMPLETING THE BOOKING, YOU VOLUNTARILY ASSUME ALL RISKS associated with the Participant's participation in the Activity, whether arising from the ordinary negligence of the Activity Provider, KidzMaps, or otherwise, EXCEPT for risks arising from the gross negligence or willful misconduct of such parties.

4. RELEASE AND WAIVER OF LIABILITY

4.1 Release of KidzMaps

You, on behalf of yourself, the Participant(s), and your respective heirs, assigns, and representatives, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE KidzMaps, LLC, its officers, directors, employees, agents, affiliates, and successors (collectively, the "KidzMaps Released Parties") from any and all claims, demands, actions, and causes of action arising from or related to:

• The Participant's participation in any Activity booked through the Platform;
• Any injury, illness, death, or property damage arising from such participation;
• Any act or omission of any Activity Provider, their staff, agents, or volunteers; and
• Any deficiency in the Platform, including errors in Activity listings or descriptions.

4.2 Release of Activity Provider

You further RELEASE the Activity Provider identified in your booking confirmation, its owners, officers, directors, employees, staff, agents, and volunteers from claims arising from the ordinary negligence of such parties in connection with the Activity.

This release does NOT apply to claims arising from:

• Gross negligence of the Activity Provider or its staff;
• Willful, wanton, or intentional misconduct;
• Criminal acts, including abuse, molestation, or assault; or
• Reckless disregard for the safety of the Participant.

5. INDEMNIFICATION

You agree to indemnify and hold harmless the KidzMaps Released Parties and the Activity Provider from any claims, damages, losses, and expenses (including attorneys' fees) arising from: the Participant's violation of rules or instructions during the Activity; any misrepresentation by you regarding the Participant's health, abilities, or eligibility; or any claim inconsistent with this Waiver.

6. MEDICAL AUTHORIZATION AND HEALTH INFORMATION

By completing the booking, you authorize the Activity Provider and its staff to seek emergency medical treatment for the Participant in the event of an emergency, including ambulance transportation, emergency room treatment, and first aid. You are responsible for all medical costs incurred.

During the booking process, you will have the opportunity to provide the following health information, which will be shared only with the applicable Activity Provider:

• Known allergies;
• Known medical conditions;
• Current medications; and
• Emergency contact information.

Providing health information is voluntary but strongly recommended for your child's safety. You are responsible for ensuring the Activity Provider has current, accurate health information for the Participant.

7. PHOTO/VIDEO RELEASE

During the booking process, you will be asked to indicate whether you grant or decline permission for the Activity Provider and KidzMaps to photograph, video record, or otherwise capture the Participant's image during Activities for use in marketing, social media, website, and promotional materials. No Child's full name will be associated with any published image. You may change your preference at any time through your account settings.

8. COMMUNICABLE DISEASE ACKNOWLEDGMENT

You acknowledge that group Activities may expose the Participant to communicable diseases, including but not limited to COVID-19, influenza, RSV, and other illnesses. You agree to keep the Participant home if they exhibit symptoms of illness and to notify the Activity Provider promptly if the Participant is diagnosed with a communicable disease within 48 hours of participation.

9. TRANSPORTATION

Unless otherwise specified in the Activity listing, you are solely responsible for transportation of the Participant to and from the Activity. If the Activity includes transportation, your completion of the booking constitutes consent for the Participant to be transported by the Activity Provider or its designee.

10. GOVERNING LAW AND SEVERABILITY

This Waiver is governed by the laws of the State of Florida. If any provision is held unenforceable, the remaining provisions remain in full force and effect. The prevailing party in any legal proceeding shall be entitled to recover reasonable attorneys' fees.

11. ELECTRONIC ACCEPTANCE

BY CHECKING THE REQUIRED CONSENT CHECKBOX DURING THE BOOKING PROCESS AND COMPLETING THE BOOKING, YOU ACKNOWLEDGE THAT: (A) YOU HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND ITS CONTENTS; (B) YOU ARE THE PARENT OR LEGAL GUARDIAN OF THE PARTICIPANT(S); (C) YOU ARE AWARE THAT THIS IS A RELEASE OF LIABILITY; AND (D) YOU ACCEPT THIS WAIVER VOLUNTARILY.

Your electronic acceptance is legally binding under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. §§ 7001-7006, and the Uniform Electronic Transactions Act (UETA).
